The other thing I don't understand is how come EB-1 and EB-2 which are current (for ROW) atleast can suddenly become U.
Did USCIS stop paying attention to EB-2 vs EB-3 classification?
How about country limits? Did USCIS give India more than 3K visas?
Also, aren't the visas released quarterly? So, how come the visas that were to be released in July, got consumed in June?

There is always Hope. For those who want guarantees even before making an attempt, just remember that seeking such assurances will certainly cause failure for everyone.
Is recapture there? Will Eb-3 or my eb2 date move? Then when will I get my green card approval? Those are all valid questions.
But perhaps we need to rise up above simple answers from a very complicated situation and just do our share, give it our best for the solutions we are looking for. Do not intended to get preachy here, but I hope you get the point.

:) when you are in India, you are NOT on H1B status.
So there is nothing to stop you to work from home in India, for 5 months or 5 years :)
The paystubs during this period is also irrelevant to USCIS regarding proof of maintaining H1 status, since you were NOT. What they care at your re-entry in H1B will be existence of valid employment in USA at that time, and proof regarding this.
So you can apply for H1 extension, get it approved, go to India, work from there for any length, return to USA based on your H1B (it has to be valid when you return, plus you may need a valid visa stamp in your passport). There are no issues.
But be careful if you have a pending 485 petition. Long stays outside of USA can be interpreted as lack of immigration intent. You better have a good explanation if you stay outside of USA for lengthier periods, with 485 pending.

You have the option of collecting your passport over the VFS counter in mumbai, and the passport is delivered between 4:30 to 5:00 PM on the next day of your interview.
The best way to get your passport is to call VFS office in mumbai between 8:30 to 2:00 PM any day 022-66547600, quote your passport number, the VFS helpdesk should be able to tell you if they have received your passport from the US consulate or not.
If the VFS personal says over the phone that they have your passport with them then you can collect the same from the VFS office.
Another option to track passport is to SMS - "VISA{space}US{Space} "passport number.

Questions if anyone has ever seen an RFE like this one.
My first RFE was asking for all documents related to work authorized by USCIS.
I think I responded properly and provided all documents requested.
Then another RFE just came in end of April mail asking for the following.
Please provide all school transcripts during your F1 student status.
Now I am dummy because up until about few days ago I just realized I made big mistake!
I have gap (7 months) from when I finished school (mid 2002) and when I was approved my H1B (Jan 2003)
I should have went on OPT after school but mistake I think I could wait pending my H1B application. I did not work during that 7 month period and stupid me did not go to school during that 7 month period in end 2002.
Any good lawyers in San Jose area think I can pass with a letter of explanation?

I never got kWordpad to do this for me. Though after you mentioned it, I went back and took another look. I noticed that if upon opening the window, I clicked on the Bold button first and then went and began typing, the Bold button would return to an unChecked state and my text would not be bold. However if I first clicked once inside of the rich textbox and then clicked the bold button, when I started typing the text would be bold.
So I went into the source and added: "this.MainRichTextBox.Focus();" directly benieth “InitializeComponent” to the Window1.xaml.cs file, so that the rich textbox would already have been ‘clicked’ upon opening and now it works just like wordpad as far as applying styles.
Are you getting similar behavior or not? If its working differently for you, is there any chance you know whats happening here?
Either way, thanks for making me take a second look. And just while I have you on the line, I want to tell you I love the website. The tutorials here are great. Most sites simply give snippits, but don’t give you all of how they achieved this or that feature. So its nice to know that when I start something here, all of the info I need to finish it or get it working is included. I'm looking forward to more in the WPF field.

P.S. Just as a side note I was curious why you have:

Just for fun I changed it to: SelectedValue=”Calibri” in the C# file and left the Selected index in Expression Blend at 0. Now when I run kWordpad the combo box has Calibri set as the defualt but resets to Arial as soon as I begin typing in the rich textbox.
What makes this really odd to me is that if it is being set by the selected index in Expression Blend, then the selected index would have to be set at 9 on my computer in order for it to choose Arial as the default (for me 0 is Abyssinica SIL). So where is it getting Arial from; and how is it that it is ignoring both the SelectedDefaultFont and the SelectedIndex? I realize this may seem tedius, but I just hate not knowing... "to be continued" at the end of a tv show makes me nuts too; I'm seeking help.

Totally agree with boreal. Also, the category that you qualify for depends upon the requirements of the job and not your qualifications. For example if the minimum requirements of the job is BS with little or no experience, you would be in an EB3 category, irrespective of whether you have a MS or a PhD.

I think you can file an FOIA (freedom of information act) form to get copy of your 140 approval from USCIS. The only problem is that it will take some time to do that.
However, do it in any case. You will need that 140 approval later on, even for filing H1 transfer after your intial 6 years are gone.
Guys and gals: Please use all tactics possible and all negotiating powers possible to get copies of approvals from your employers for your file. Whether its 140 or H1, you should have copies of them. The copies are not employer's properties. The petitions are. A photocopy is a piece of paper that says something. If you have photocopy, doesnt mean you own that H1 or 140. Dont fall for this bullshit that "H1 and 140 are properties of the employer so we cant give it to you". BULLSHIT. If someone has a photocopy of the title of my car, does it mean that he owns that car?? NO. I still own it. Anyone can have a photocopy of it. In fact, DMV does have a copy of it. HAVING XEROX COPIES DONT IMPLY TRANSFER OF OWNERSHIP OR OWNERSHIP OF PETITIONS.
PLEASE FIGHT THIS BULLSHIT AND TRY TO GET OUT OF THE MESS.

The Nation's Isabel Macdonald writes that while Dobbs has bashed employers for hiring immigrants without papers, he "has been far from vigilant about the status of workers laboring on his own properties." (The Nation has long editorialized against Dobbs and those who agree with him on immigration.)
Dobbs owns a 300-acre estate in Sussex, N.J., and a winter home in West Palm Beach, Fla. His daughter keeps five show horses worth about $1 million each at several stables; the horses are owned by the Dobbs Group, of which Lou Dobbs is president.
Macdonald spoke with several immigrants who were employed to work on winter property and helped with the upkeep of Dobbs' horses at stables in Vermont and Florida. Did they send you RFE for all the job ads and is that how they found out the date missing? I did not know people get RFE for job ads. Thanks.
I looked at your signature timeline and it says "LC denied due to date missing on ad portion." Could you please clarify what happened? My job ads are running right now for PERM LC and not sure what I need to keep from the newspaper ad.

I am currently looking for a job and I have a US Master's degree. I am stuck in this retrogression and my lawyer applied for EB3, and I have no choice but looking for another job that requires me a M.S. with higher salary so I could apply for EB2
Do you know where I can see which is the minimum wage for applying as EB2?? I remember in my Labor certification there was a place where I used to check minimal wage requirements.
I am rest of the world, and having an EB2 application will let me jump out of the retrogression if EB2 continues to be available

I understand your pain. I have master and over 8 years experience. For some reason, my company filed my applicaiton for EB-3 *&@#$%^ :mad: I don't understand their intention. I asked HR why and they answered that this was "Company Policy" *&@#$%^ :mad:
I am also actively looking for a new job which will file EB-2 for me. Let's wish both of us good luck!!

I don't mean to hijack the thread and my PD is 2010 anyway but I have a question also.
We know that we need to get all this vaccination thing done during 485 stage and a civil surgeon does that. But do we need to get all this done/verified at our regular physician before we go to the civil surgeon?
All of us have these polio, measles thing done but we don't have a record to show. So does the doc give us new/follow up shots to fulfill the criteria...and we take that to the civil surgeon.
looks like the civil surgeon is just a stamping authority, the real deal has to be done by our doc. Please let me know.
